Welcome to Mocapster. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our motion capture and character replacement software and related services (collectively, the "Service"). By accessing or using the Service, you agree to the terms of this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access the Service.

2. Information We Collect

2.1 Information You Provide

Account Information: Your email address, collected during account registration through Firebase Authentication (provided by Google).

User-Uploaded Content: Videos and reference images that you upload to the Service for motion capture processing and character replacement.

Payment Information: Billing and payment details are collected and processed entirely by Stripe, Inc. Mocapster does not store, process, or have access to your full credit card number or payment credentials. Communications: Information you provide when you contact us for support, submit feedback, or communicate with us.

2.2 Information Collected Automatically

Usage Data: Information about how you interact with the Service, including features used, video generation counts, credit usage, and session duration.

Device and Log Data: IP address, browser type, operating system, device identifiers, and access timestamps.

Cookies and Tracking Technologies: We use cookies, pixels, and similar technologies to enhance your experience, analyze usage, and deliver relevant content. Firebase Authentication may set cookies or tokens for session management.

3. How We Use Your Information

We use the information we collect for the following purposes:

• To provide, operate, and maintain the Service, including processing your video uploads and generating motion capture outputs.

• To authenticate your identity and manage your account via Firebase Authentication.

• To process transactions and manage your subscription and credit balance via Stripe.

• To improve, personalize, and optimize the Service and user experience.

• To communicate with you, including sending service-related notices, updates, and promotional materials (with your consent where required).

• To detect, prevent, and address fraud, abuse, security issues, and technical problems.

• To comply with legal obligations and enforce our Terms of Service.

4. User-Uploaded Content

Our Service allows you to upload videos and reference images for processing. Please note the following:

• Your uploaded videos and reference images are processed on our servers solely to deliver the requested motion capture and character replacement output.

• We do not use your uploaded content to train machine learning models unless you explicitly opt in to such use.

• Uploaded content and generated outputs are retained indefinitely on your account unless you choose to delete them or delete your account entirely.

• You are solely responsible for ensuring you have the right to upload and use any content you submit, including videos of other individuals and reference images of characters or persons. Mocapster is not liable for content uploaded by users.

5. How We Share Your Information

We do not sell your personal information. We may share your information with the following third parties:

Stripe, Inc.: Processes all payments and billing on our behalf. Stripe receives your payment information directly. See Stripe's Privacy Policy at https://stripe.com/privacy.

Google/Firebase: Provides authentication services. Your email address and authentication tokens are processed by Firebase. See Google's Privacy Policy at https://policies.google.com/privacy.

Microsoft Azure: Our Service is hosted on Microsoft Azure infrastructure. Your data, including uploaded content, is stored and processed on Azure servers. See Microsoft's Privacy Statement at https://privacy.microsoft.com/privacystatement.

Legal Requirements: We may disclose your information when required by law, regulation, legal process, or governmental request.

Business Transfers: In connection with a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction.

Protection of Rights: To protect and defend the rights, property, or safety of Mocapster, our users, or others.

6. Data Storage and Hosting

All data is hosted on Microsoft Azure infrastructure. Your uploaded content and account data are stored in Azure data centers. 7. Data Retention

We retain your email address and account information for as long as your account is active. Uploaded content and generated outputs are retained indefinitely unless you delete them or delete your account. Upon account deletion, we will delete your personal data within 30 days, except where retention is required by law.

8. Data Security

We implement industry-standard technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption in transit and at rest via Azure's security infrastructure, Firebase Authentication security protocols, Stripe's PCI-DSS compliant payment processing, and access controls and regular security assessments. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

9. Your Rights and Choices

Depending on your jurisdiction, you may have the following rights regarding your personal information:

Access and Portability: Request a copy of the personal information we hold about you.

Correction: Request correction of inaccurate or incomplete information.

Deletion: Request deletion of your account and all associated personal information, uploaded content, and generated outputs.

Opt-Out: Unsubscribe from marketing communications at any time by using the unsubscribe link in our emails or contacting us.

10. Rights for Users in the European Economic Area (EEA)

Additional Rights: In addition to the rights listed in Section 9, EEA users have the right to restrict processing of your personal data in certain circumstances, the right to object to processing based on legitimate interests, and the right to lodge a complaint with your local data protection authority.

Data Transfers: Your data may be transferred to servers located outside the EEA, including in the United States. We rely on standard contractual clauses and our third-party providers' data protection frameworks to ensure adequate protection of your data.

11. Children's Privacy

The Service is not intended for individuals under the age of 13 (or 16 in the EEA, or the applicable age of digital consent in your jurisdiction). We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child without parental consent, we will take steps to delete that information promptly.

12. International Data Transfers

Your information may be transferred to and processed in countries other than the country in which you reside, including the United States, where our third-party providers (Stripe, Firebase, and Azure) may operate data centers. We take appropriate safeguards to ensure that your personal information remains protected in accordance with this Privacy Policy.

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors.
